Sonia Sotomayor...........a Minority quota Pick?

President Obama has nominated the anti-Second Amendment Judicial Activist Sonia Sotomayor to replace retiring Justice David H. Souter as the next Associate Justice to the Supreme Court of the United States. This is unacceptable in more ways than one to a huge segment of the American people. She has a preconceived adverse opinion on what the Second Amendment means. She has publicly stated that she believes that judges in the courts should have a large part in making government policy. It is the Executive Branch of Government that sets policy, not the Judicial Branch. She believes that empathy should be a part of judicial decisions. These are not characteristics we look for in a nominee to the Supreme Court.

It appears that Judge Sotomayor is a minority quota pick, she is Latino, and she is a woman. She has a strong disposition on issues that would not allow her to make rational opened minded decisions on some cases brought before the court. Neither Empathy, nor preconceived notions on certain issues should enter into a judges decisions on cases presented to the court, whether they be assenting or dissenting opinions.

As a Constitutional Scholar, President Obama should know better than to nominate anyone that cannot be impartial, and open minded when hearing the cases argued before them. It is the mission so to speak of the Supreme Court to apply the Constitution to the law or case presented to them, and to make their decisions based solely on how the Constitution applies to the case being presented; Constitutionality is the key, no biases, no preconceived notions or opinions, and no empathy. Judge Sotomayor is a very bad choice to fill this Supreme Court Vacancy. Sadly, she will be confirmed and we will be burdened with a bad choice for life.

  1. The role of the Judicial Branch is to administer justice under the laws as provided by the constitution. The Law MUST REMAIN STABLE AND PREDICTABLE. A United States Supreme Court Judge must remain an impartial administrator. Bringing empathy, emotion or any other other preconceived notion of social equity or personal idealogy into the discussion removes the possibility of equal justice for all.
