This Post is addressed to the President, and to all members of Congress.
In case you have forgotten your Oath of Office, and your swearing to preserve the United states Constitution I want to give you a refresher on what the Constitution has to say about the Census of our great country.
"Article I, Section I. All Legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and a House of Representatives."
"Article I, Section 2, clause 3: Representatives and direct taxes shall be apportioned among the several States which may be included within this Union, according to their respective numbers, which shall be determined by adding the whole Number of free persons, including those bound to service for a Term of years, and excluding Indians not taxed, three fifths of all other persons ( the Fourteenth Amendment addressed the equal protection clause for Indians). The actual enumeration shall be made within three Years after the first meeting of the Congress of the United States, and within every subsequent term of ten Years, in such manner as they shall by Law direct. The number of Representatives shall not exceed one for every thirty Thousand, but every State shall have at least one Representative……….."
It is perfectly clear that the Census task falls under the auspices of the Legislative Branch of Government. Until just recently the census was a responsibility of the Department of Commerce, which falls under the Legislative Branch of Government.
Why is it that the Executive Branch of Government has taken over a task, whose responsibility clearly falls under the Legislative Branch? I understand now that ACORN is working its way back into the Census taking effort under President Obama's administration. Why is this? ACORN has been proven unequivocally dishonest, heavy handed enforcers for this administration, and notably guilty of voter registration fraud.
By what authority has the Executive Branch hijacked an effort that clearly belongs to the Department of Commerce under the Legislative Branch? The action that is taking place requires a Constitutional Amendment.
Further, the Constitution specifically states "enumerated………every ten years". Enumerated by definition means "To determine the number of,…..count". The Government is in violation our Constitutional rights by forcing the people to reveal personal information that is no ones business but the individuals.
The Questionnaire that I understand is coming with the Census Form is an invasion of privacy, and demands personal/family information, that far exceeds "Enumeration." The penalty for failing to fill out the required information…………... $5,000, and threaten them with prosecution and possible prison time? I think you had better get real. I personally will provide what the Constitution requires me to provide to satisfy the Census requirement,…..you can ENUMERATE me!
